Equipment Damage, Loss, and Cleaning Policy

This policy explains your responsibilities for the condition of rented equipment, and what happens if equipment is damaged, lost, or not returned clean.

Overview

From the time you pick up your equipment until it is returned to Gameday Comforts, you are responsible for its care, consistent with this policy and our Rental Terms and Conditions.

Inspecting your equipment

Please inspect your equipment at pickup and let our staff know right away if anything appears damaged or is missing an accessory, so it can be noted before your rental period begins.

Returning equipment clean and complete

Equipment must be returned reasonably clean and complete with all accessories supplied at pickup. If equipment is returned soiled materially beyond ordinary outdoor use, we may charge the reasonable, documented cost of cleaning it. Accessories supplied with an item that are missing at return are addressed separately, below.

Lost, stolen, destroyed, or materially damaged equipment

You are responsible for reasonable costs if rented equipment is lost, stolen, destroyed, or materially damaged during your rental period, other than ordinary wear and tear. Those costs are limited as follows:

  • If the item can be repaired, you are responsible for the reasonable, documented cost of repair.
  • If repair is impractical, or the item is lost, stolen, or destroyed, you are responsible for the item's actual replacement value.
  • In no case will the amount charged for a single item exceed that item's reasonable replacement value.
  • Accessories supplied with an item that are missing at return are addressed separately from the item itself and are not included in, or limited by, the item's replacement value.

Ordinary wear and tear

You are not responsible for ordinary wear and tear that results from the equipment's normal, intended use.

Safe use of equipment

We may refuse continued use of equipment we reasonably believe is being used unsafely, and may require that it be returned to us immediately. Damage resulting from unsafe or improper use is not considered ordinary wear and tear.

How charges are determined and requested

If we determine that a charge applies under this policy, we will give you written notice explaining the charge and the basis for it, supported by reasonable documentation such as photos, a repair estimate, or a replacement cost. We do not automatically bill your original payment method or any card on file. Instead, we will request payment separately, through a payment method you authorize at that time.

Before requesting payment, we will give you a reasonable opportunity to ask questions about, or dispute, the charge, except where applicable law permits us to proceed without doing so.
